1. Acceptance
By using the Service, you agree to be bound by these Terms and any policies referenced here. If you do not agree, do not use the Service.
If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. The Service
The Service provides VPN connectivity to help protect traffic in transit and enhance privacy. The Service may include different protocols, server locations, and features that may change over time.
We may modify, update, suspend, or discontinue any part of the Service at any time. We may also set reasonable limits to protect the Service and other users.
3. Eligibility (18+)
You must be at least 18 years old to use the Service. By using the Service you confirm you meet this requirement.
4. Accounts
You may create an account using Google Sign-In or email/password. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it.
You agree to provide accurate information and to keep your account information up to date. You must promptly notify us of any suspected unauthorized use of your account.
5. User Responsibilities
By using the Service, you accept responsibility for:
- complying with all applicable laws and regulations in your jurisdiction;
- not using the VPN as infrastructure for attacks, abuse, or illegal activities;
- keeping your account credentials secure and not sharing them with others;
- managing your Google Play subscription independently, including cancellation if you no longer wish to use the Service;
- promptly notifying us of any unauthorized use of your account;
- understanding that using a VPN does not make illegal activity legal.
6. Our Commitments
We commit to:
- operating the Service consistent with our published Privacy Policy and these Terms;
- implementing reasonable administrative, technical, and organizational security measures;
- not selling your personal data to third parties;
- not logging your browsing history, DNS queries, or traffic contents;
- limiting data processing to what is necessary to provide the Service;
- responding to account deletion requests within the timeframe stated in our Account Deletion page.
7. License & Ownership
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the app for your personal, non-commercial use. We (and our licensors) retain all rights, title, and interest in and to the Service, including all intellectual property rights.
You may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract the source code of the Service except to the extent permitted by applicable law.
8. Acceptable Use
6.1 General Prohibitions
You agree not to use the Service to:
- violate any applicable laws or regulations;
- infringe intellectual property or other rights of others;
- distribute malware, engage in phishing, or attempt unauthorized access;
- interfere with or disrupt the Service, servers, or networks;
- resell, sublicense, or provide the Service to third parties unless explicitly authorized in writing.
6.2 Prohibited Technical Activities
You specifically agree NOT to use the Service for:
- network scanning, port scanning, or service enumeration;
- use of tools such as nmap, masscan, zmap, or similar scanning utilities;
- penetration testing, vulnerability scanning, or exploitation attempts against systems you do not own or have explicit authorization to test;
- denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks;
- traffic flooding, amplification attacks, or reflection attacks;
- brute-force attacks against any external system or service;
- operating or communicating with botnets, malware infrastructure, or command-and-control servers;
- sending spam, phishing emails, or unsolicited bulk communications;
- any activity that generates abuse complaints to our infrastructure providers.
6.3 Enforcement
We may investigate suspected violations and may suspend or terminate accounts involved in abuse or activities that threaten the Service, our infrastructure, or other users. Violation of this Acceptable Use section may result in:
- immediate suspension or termination of your account without prior notice;
- revocation of your VPN configurations across all servers;
- no refund for any unused subscription period;
- reporting to relevant authorities if required by law.
9. Subscriptions, Trials, Refunds
7.1 Google Play Billing
ZenVault VPN on Android uses Google Play Billing. Purchases, renewals, cancellations, and refunds are handled by Google Play and are subject to Google’s terms and policies. You can manage your subscription in Google Play under Payments & subscriptions.
7.2 Trials
Trial availability and duration may vary and may be limited (for example, one per user/device). We may change or discontinue trials at any time.
7.3 Refunds
Refunds (if available) must be requested through Google Play. We do not process refunds directly.
10. Third-Party Services
The Service relies on third-party services (for example, Google Sign-In, Google Play Billing, Firebase/Google Cloud). Your use of those services may be governed by their own terms and policies. We are not responsible for third-party services outside our control.
11. Disclaimers
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected. Network conditions, third-party networks, and device limitations can affect performance.
12. Limitation of Liability
To the maximum extent permitted by law, Infracloud LLC and its affiliates, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, goodwill, or business interruption, arising out of or related to your use of the Service.
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid for the Service in the twelve (12) months before the event giving rise to the claim, or USD $10 if you have not paid anything.
13. Indemnity
You agree to defend, indemnify, and hold harmless Infracloud LLC from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your misuse of the Service, your violation of these Terms, or your violation of any rights of a third party.
14. Suspension & Termination
We may suspend or terminate your access to the Service if we reasonably believe you have violated these Terms, used the Service for abuse, or created risk or legal exposure for us or other users.
You may stop using the Service at any time. You may request account deletion as described in Account Deletion.
15. Export & Compliance
You agree to comply with applicable export control and sanctions laws and regulations. You may not use, export, or re-export the Service where prohibited by law.
16. Force Majeure
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including outages, acts of government, sanctions, network failures, or failures of hosting providers, data centers, or telecommunications networks.
17. Changes
We may update these Terms from time to time. The “Last updated” date indicates when changes became effective. If changes are material, we may provide additional notice where appropriate.
18. Miscellaneous
18.1 Assignment
We may assign or transfer these Terms (in whole or in part) in connection with a merger, acquisition, reorganization, or sale of assets. You may not assign these Terms without our prior written consent.
18.2 Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
18.3 Entire Agreement
These Terms, together with the referenced policies, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements on the subject.
19. Governing Law
These Terms are governed by the laws of Armenia, without regard to conflict of law principles. You agree that disputes will be resolved in the competent courts of Armenia, unless applicable law provides otherwise.
